The Ministry of Finance (MoF) has established the Public Private Partnership (PPP) Unit in 2015 named as the Directorate of Government Support and Infrastructure Financing Management (DGSIFM) at Directorate General of Budget Financing and Risk Management to support infrastructure development in Indonesia through private participation. The DGSIFM works closely with the Government Contracting Agencies (GCA) on the development of PPP projects and with other agencies on the provision of Government support. In addition, DGSIFM also undertakes PPP awareness campaigns and provides capacity building to the GCAs and other relevant stakeholders.
As part of its proposed plan for the next five years, the DGSIFM aims to focus its attention and accelerate PPP transactions in Urban Transport, Water Supply and Waste Water, Solid Waste Management, Health, Housing and Energy. Towards this end, the DGSIFM seeks to strengthen its capacity to analyze legal, contractual and fiscal risk issues related to PPP transactions that are based on international best practice1 and in compliance with Indonesian laws and regulations.
This assistance is expected to be supported by the Indonesia Infrastructure Finance Development (IIFD) for PPPs. The IIFD is being a multi donor trust fund, being managed by the World Bank, with funding support from the Department of Foreign Affairs and Trade for Development (DFATD) of the Government of Canada (IIFD TF). The trust fund (TF) was launched in April 2015 and is being implemented through a Bank-Executed Trust Fund (BETF) and a Recipient Executed Trust Fund (RETF) up to year 2021. The MOF’s PPP Unit is the recipient for the RETF. The outcome of this activity closely links to the objective of the IIFD, which is to accelerate the implementation of PPP projects and contribute to the efficient and effective infrastructure spending..
This REOI describes the objective and needs of Legal Consultant to advise DGSIFM on legal, contractual and fiscal risk issues on specific PPP transactions that would come for appraisal, evaluation and approval to the DGSIFM, through the services of a Legal Specialist. It is likely that these PPP projects would seek some form of government support, such as through Viability Gap Fund (VGF), Government Guarantee, Availability Payment (AP) scheme, or other combinations and forms.
The Ministry of Finance now invites eligible Individuals Consultants to indicate their interest in providing the above Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. Only the experience and qualified individuals shall be considered in the selection process.

The consulting assignment will be located in Jakarta, and is expected to start in December 2019. The Consultant shall perform the services on lump-sum basis in the indicative Level of Effort of 85 person-days. This assignment will be for a period of December 2019 through December 2020.
